The Federal Emergency Management Agency (FEMA) has received the subgrant application for the City of North Port Water Treatment Plants due to damages from Hurricane Ian (DR-4673-FL). Pursuant to Executive Order 11988 and 44 CFR Part 9.12, final notice is hereby given of FEMA’s intent to provide funding for projects under the Public Assistance (PA) Program.

An initial disaster-wide Public Notice for Hurricane Ian (DR-4673-FL) was published October 18, 2022. Comments and other information received were fully evaluated by FEMA along with evaluation of social, economic, environmental, and safety considerations. This notice serves as a project-specific final notice for FEMA’s funding of an action located within the floodplain. FEMA has determined the only practicable alternative is to rebuild the damaged components of the water treatment plants in the floodplain because the facility provides essential water treatment services for the surrounding community.

Funding for the proposed project will be conditional upon compliance with all applicable federal, tribal, state and local laws, regulations, floodplain standards, permit requirements and conditions. This action complies with the National Flood Insurance Program (NFIP) requirements.

NOTICE OF FINDING OF NO SIGNIFICANT IMPACT AND NOTICE OF INTENT TO REQUEST RELEASE OF FUNDS
REQUEST FOR RELEASE OF FUNDS

On or about May 26, 2025 the City of North Port will submit a request to the Florida Department of Commerce for the release of Community Development Block Grant (CDBG) funds under Title I of the Housing and Community Development (HCD) Act of 1974, as amended, to undertake a project to install new permanent diesel bypass pumps at key lift stations: 23, 25, 30, 37, 38, 39, 43, and 63. These pumps will increase the reliability of the wastewater system during power failures caused by storm events such as Hurricane Irma, which has caused damage to the City in the past. By adding these pumps, the City aims to prevent wastewater overflows and ensure that wastewater continues to flow even during power failures, keeping the system functioning properly. The City intends to use HUD funds from Grant #IR027 in the amount of $650,440.00 and non-HUD funding for the proposed project. Non-HUD funding is estimated to be $249,560.00 and will be utilized from the City’s utility budget.

FINDING OF NO SIGNIFICANT IMPACT
The City of North Port has determined that the project will have no significant impact on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. Additional project information is contained in the Environmental Review Record (ERR) on file at the City of North Port located at 4970 City Hall Boulevard, North Port, Florida 34286 and may be examined or copied on weekdays from 8:00 A.M to 5:00 P.M.

PUBLIC COMMENTS
Any individual, group, or agency may submit written comments on the ERR to Jennifer Sadonis, Grants Coordinator at the City of North Port. Additional project information is contained in the ERR on file at the City of North Port located at 4970 City Hall Boulevard, North Port, Florida 34286 and may be examined or copied on weekdays from 8:00 A.M to 5:00 P.M. All comments must be received by May 26, 2025.  Comments will be considered prior to the City of North Port requesting a release of funds and should specify which Notice they are addressing.

ENVIRONMENTAL CERTIFICATION
The City of North Port certifies to the Florida Department of Commerce that Jerome Fletcher, II, ICMA-CM, MPA in his capacity as City Manager consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. The Florida Department of Commerce’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the City of North Port to use the CDBG funds.

OBJECTIONS TO RELEASE OF FUNDS
Florida Department of Commerce will accept objections to its release of fund and the City of North Port’s certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the City of North Port; (b) the City of North Port has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58; (c) the grant recipient or other participants in the development process have committed funds or incurred costs not authorized by 24 CFR Part 58 before approval of a release of funds by the State; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and shall be addressed to the Florida Department of Commerce, CDBG Program, MSC-400, 107 East Madison Street, Tallahassee, FL 32399-6508.  Potential objectors should contact FloridaCommerce to verify the actual last day of the objection period.

NOTICE OF INTENT TO REQUEST RELEASE OF FUNDS
REQUEST FOR RELEASE OF FUNDS

On or about May 16, 2025 the City of North Port will submit a request to the Florida Department of Commerce for the release of Community Development Block Grant funds under Title I of the Housing and Community Development (HCD) Act of 1974, as amended, to undertake a project to rehabilitate the City’s existing gravity wastewater collection system piping that currently contributes to extraneous inflow and infiltration into the City’s wastewater collection system.  This project is anticipated to utilize Cured-in-Place Pipe (CIPP) lining for the rehabilitation of the most critical sections of existing Vitrified Clay Pipe (VCP) to mitigate inflow and infiltration into the City’s collection system. This proposed project is focused, specifically, within five neighborhoods/areas: Holiday Park, Biscayne Villas, Cheseboro, Fabian, and Spearman. The City intends to use HUD funds from Grant #IR025 in the amount of $1,150,000.00 and non-HUD funding for the proposed project. Non-HUD funding is estimated to be $247,955 and will be utilized from the City’s utility budget.

The City of North Port has determined that the activities proposed are categorically excluded under HUD regulations at 24 CFR Part 58 from the National Environmental Policy Act of 1969 (NEPA) requirements.  Additional project information is contained in the Environmental Review Record (ERR) on file at the City of North Port located at 4970 City Hall Boulevard, North Port, Florida 34286.

Backflow Device Testing

Beginning on October 1, 2023, a $3.50 fee will be assessed to customer accounts whose backflow tests are submitted by means other than the North Port Utilities' (NPU) online backflow portal. Please verify that your certified backflow testing company is registered with NPU and will be recording your completed test online to avoid the additional fee.

North Port Utility water customers are required to have their backflow device tested every other year as a requirement by the Florida Department of Environmental Protection. For our water customers who were notified of their due date falling between February, 2021 to August, 2021, if you have not submitted your backflow test results, your service may be suspended in the coming days. Please help us help you keep your water on by submitting your documentation. Backflow testing is necessary under FAC 62-555 Cross Connection Control to protect our municipal drinking water (potable water) from backflow contamination.
